Welcome to CREHQ. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and CREHQ ("we," "us," "our," or "CREHQ") governing your access to and use of our website at crehq.com and all related services (collectively, the "Service").

Age Requirement
You must be at least 18 years of age to use CREHQ. By using the Service, you represent that you meet this requirement.
Account Registration
To access certain features, you must create an account. When you register, you agree to:

- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities under your account
Account Responsibility

What CREHQ Is NOT
CREHQ is an information platform, not a licensed broker, advisor, or agent. We do not:
- Provide legal, financial, investment, or tax advice
- Represent buyers, sellers, landlords, or tenants in transactions
- Guarantee the accuracy or completeness of any data
- Endorse or recommend any particular companies, properties, or transactions
Any decisions you make based on information from CREHQ are your own responsibility. You should independently verify information and consult with qualified professionals before making business decisions.
5. Subscriptions, Billing & Renewals
Subscription Tiers
CREHQ offers multiple subscription levels:
- Free: Limited access to company data and basic features
- Pro: Full access to company profiles, tenant requirements, search filters, and export capabilities
- Team: Pro features plus multi-user access, shared saved lists, and team collaboration tools

Billing Cycles & Auto-Renewal
Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
You authorize us to charge your payment method at the beginning of each billing cycle until you cancel.
Cancellation
You may cancel your subscription at any time through your account settings or by contacting us at [email protected]. Upon cancellation:
- You will retain access until the end of your current billing period
- No refunds will be provided for the unused portion of the current billing period
- Your account will revert to Free tier access after the paid period ends
Refunds

6. Acceptable Use
Permitted Uses
You may use CREHQ to:
- Research retail and restaurant brands for professional purposes
- Identify expansion opportunities and tenant requirements
- Build prospecting lists within your subscription limits
- Access data to support your commercial real estate business
- Export data as permitted by your subscription tier for your internal business use
Prohibited Activities
You may NOT:
- Scrape, crawl, or automated harvest data from CREHQ using bots, scripts, or automated tools (except as explicitly permitted via an authorized API)
- Resell, redistribute, or sublicense CREHQ data to third parties without our written consent
- Create competing products or services using data obtained from CREHQ
- Use contact information obtained from CREHQ for spam or unsolicited bulk communications
- Circumvent access controls or attempt to access features beyond your subscription tier
- Share account credentials with unauthorized users
- Impersonate others or provide false information
- Interfere with or disrupt the Service or its infrastructure
- Violate any applicable laws in your use of the Service
- Use the Service for illegal purposes including fraud, harassment, or infringement
We reserve the right to investigate suspected violations and take appropriate action, including suspending or terminating your account.
7. Intellectual Property

CREHQ owns or licenses all intellectual property rights in the Service, including:
- The CREHQ name, logo, and trademarks
- The website design, layout, and user interface
- Our proprietary database structure and compilation
- Original content, analysis, and insights we create
- Software, code, and technical infrastructure
Limited License to You
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes during your subscription period. This license does not include the right to:
- Modify, copy, or create derivative works of the Service
- Reverse engineer or extract source code
- Remove any proprietary notices or labels
- Use the Service to build a competing product

When you submit content, you represent that:
- You have the right to submit the content and grant the license above
- The content is accurate to the best of your knowledge
- The content does not violate any laws or third-party rights
- The content is not defamatory, obscene, or otherwise objectionable

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. To the maximum extent permitted by law, CREHQ disclaims all warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Service will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, completeness, or reliability of any data or content

11. Limitation of Liability
To the maximum extent permitted by law:
CREHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
OUR TOTAL LIABILITY for any claims arising from these Terms or your use of the Service shall not exceed the greater of: (a) the amounts you paid to CREHQ in the 12 months preceding the claim, or (b) one hundred dollars ($100 USD).
These limitations apply regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if CREHQ has been advised of the possibility of such damages.
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless CREHQ and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service
- Your violation of applicable laws or regulations
13. Termination & Suspension
Termination by You
You may terminate your account at any time by canceling your subscription and requesting account deletion through your account settings or by contacting [email protected].
Termination or Suspension by CREHQ
We may suspend or terminate your access to the Service, with or without notice, if:
- You violate these Terms
- You fail to pay subscription fees when due
- We reasonably believe your account has been compromised
- We are required to do so by law
- We discontinue the Service (with reasonable notice)
Effect of Termination
Upon termination:
- Your right to access the Service ends immediately
- You remain liable for any amounts owed
- Provisions that should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will continue in effect
- We may delete your account data after a reasonable retention period, subject to our Privacy Policy
14. Governing Law & Dispute Resolution
Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to conflict of law principles.
Dispute Resolution: Any dispute arising from these Terms or your use of the Service shall be resolved as follows:
- Informal Resolution: Before initiating formal proceedings, you agree to contact us at [email protected] to attempt to resolve the dispute informally
- Jurisdiction: If informal resolution fails, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Madison, Wisconsin
You agree to waive any right to a jury trial and to participate in a class action lawsuit or class-wide arbitration against CREHQ.
15. Changes to These Terms
We may modify these Terms at any time. When we make material changes:

- We may notify you by email or through a notice on the Service
- We will provide reasonable notice before changes take effect
Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
